Public Foreclosure Notice
NOTICE OF MORTGAGE FORECLOSURE SALE Notice of foreclosure by advertisement Notice is given under section 3212 of the revised judicature act of 1961, 1961 PA 236, MCL 600.3212, that the following mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at a public auction sale to the highest bidder for cash or cashier's check at the place of holding the circuit court in Ingham County, starting promptly at 10:00 a.m., on Thursday, April 16th. The amount due on the mortgage may be greater on the day of the sale. Placing the highest bid at the sale does not automatically entitle the purchaser to free and clear ownership of the property. A potential purchaser is encouraged to contact the county register of deeds office or a title insurance company, either of which may charge a fee for this information. The Mortgage in default and being foreclosed is described as: Mortgage made by 503 S. Capitol, LLC (“Mortgagorâ€), as mortgagor, to Dwight Mortgage Trust LLC, a Delaware limited liability company as mortgagee, dated as of August 9, 2021 and recorded August 9, 2021 as Instrument No. 2021-034950, Ingham County Records, Michigan (the “Mortgageâ€). The Mortgage was assigned to Dwight Commercial Mortgage LLC by that certain Assignment of Construction Mortgage, Security Agreement and Fixture Filing recorded May 18, 2022 as Instrument No. 2022-020459, Ingham County Records, Michigan. The Mortgage was further assigned to Midland States Bank by that certain Assignment of Construction Mortgage, Security Agreement and Fixture Filing dated as of December 14, 2021 and recorded January 19, 2024 as Instrument No. 2024-001162 in the Ingham County Records, Michigan. The Mortgage was assigned to DCM CITY VIEW LENDER LLC, a Delaware limited liability company (“Lenderâ€) by that certain Assignment of Mortgage, dated as of October 17, 2025 and recorded November 14, 2025 as Instrument No. 2025-029536, Ingham County Records, Michigan. The amount due on the Mortgage as of the date of this Notice is $37,065,307.98. This amount does not reflect the total amount due on the Mortgage for some or all of the amounts paid by Lender to collect the debt or to protect its rights under the Mortgage or otherwise due under the Mortgage. The Mortgage contains a power of sale and no suit or proceeding at law or in equity has been instituted to recover the debt secured by the Mortgage, or any part of the Mortgage. The public auction described above may be adjourned to a later date; and the specific location within the place of holding of the circuit court where the public auction is held may be designated by the sheriff or deputy sheriff conducting the sale. Lender will apply the sale proceeds to the amount due on the Mortgage as stated above, plus any amount subsequently paid by Lender to protect its interest in the property, plus interest on the amount due at the rate equal to SOFR plus 16.60 percentage points per annum. Capitol Ave., Lansing, MI Tax Parcel No.: 33-01-01-16-381-006 Together with all tangible personal property and fixtures described in the Mortgage, including, but not limited to, the following: All buildings, structures, improvements and fixtures (including but not limited to all lighting fixtures and mechanical equipment) erected or placed in or upon the Mortgaged Property or attached to or used in connection with the Mortgaged Property to the extent such items may be considered part of the Mortgaged Property under applicable law; All tenements, hereditaments, casements, appurtenances and other rights and privileges thereunto attaching and belonging, or in any way appertaining to the Mortgaged Property, including without limitation (i) all surface and subsurface soils, (ii) all minerals, elements, oil, gas, and other commercially valuable substances which may be in, under or produced from any part of the Mortgaged Property (in accordance with MCL 565.81 et seq.), (iii) all air rights, and (iv) all water and water rights; and All furniture, equipment, inventory, fixtures, and tangible personal property in which Mortgagor has an interest, individually or with others, and which are located upon, used in connection with, related to or arising out of the Mortgaged Property, and all additions, accessions and accretions to, replacements and substitutions for, products of and proceeds from any of the foregoing.
