FORECLOSURE NOTICE ATTENTION TO HOMEOWNER: If you are a military service member on active duty, if your period of active duty has concluded less than 90 days ago, or if you have been ordered to active duty, please contact the attorney for the party foreclosing the Notice of Lien at the telephone number stated in this notice. Default has been made by Budha Subba and Hira Budathoki-Subba, of 3711 Cedar Landing Dr., S.E., Kentwood, Michigan 49512 (the "Owner"), in the terms and conditions of the recorded Bailey's Grove Nos. 1-26 Declaration of Restrictions recorded May 13, 2008, as Instrument Number 20080513-0046602, Kent County, Michigan records, by reason of Owner's failure to pay annual dues and other sums owed to BAILEY'S GROVE PROPERTY OWNERS ASSOCIATION (the "Association"). A Notice of Lien for nonpayment of Association assessments ("Notice of Lien") was recorded with the Kent County Register of Deeds on February 9, 2026, as Instrument No. 202602090007723, and has been served upon the Owner. The amount owed under the Notice of Lien as of the date of this Notice is Two Thousand Two Hundred Fifty-Five and 00/100 Dollars ($2,255.00). Notice of foreclosure by advertisement – notice is given under Section 3212 of the Revised Judicature Act of 1961, 1961 PA 236, MCL 600.3212 and under the power of sale contained in the Bailey's Grove Nos. 1-26 Declaration of Restrictions recorded May 13, 2008 as Instrument Number 20080513-0046602, Kent County, Michigan records and in the terms and conditions of the Bailey's Grove Property Owners Association document recorded February 7, 2002 in Liber 5868, Page 511, Kent County, Michigan records and the corresponding November 4, 1996 Non-Profit Articles of Incorporation and Bylaws of the Bailey's Grove Property Owners Association, that the above Notice of Lien will be foreclosed by a sale of the liened premises, or some part of them, at public auction sale to the highest bidder for cash or cashier's check at the place of holding the circuit court in Kent County, (that being the Kent County Courthouse, 180 Ottawa Avenue, N.W., Grand Rapids, Michigan 49503), starting promptly at 10:00 a.m. on Wednesday, the 17th day of June, 2026. The amount due on the Notice of Lien may be greater on the day of the sale and may include interest, costs, charges and expenses, including attorney fees, and also any sums which may be paid by the Association in order to protect its interests. Placing the highest bid at the sale does not automatically entitle the purchaser to free and clear ownership of the premises. A potential purchaser is encouraged to contact the County Register of Deeds office or a title insurance company, either of which may charge a fee for this information. If the premises is sold at foreclosure sale under Chapter 32 of the Revised Judicature Act of 1961, as amended, then under applicable law, including MCL 600.3278, the owner of the premises will be held responsible to the person who buys the premises at the foreclosure sale and/or to the Association for damaging the premises during the redemption period.
