NOTICE OF MORTGAGE FORECLOSURE SALE Notice of foreclosure by advertisement. Notice is given under section 3212 of the revised judicature act of 1961, 1961 PA 236, MCL 600.3212, that the following mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at a public auction sale to the highest bidder for cash or cashier's check at the place of holding the circuit court in Kent County, starting promptly at 10:00 a.m. on January 14, 2026. The amount due on the mortgage may be greater on the day of the sale. Placing the highest bid at the sale does not automatically entitle the purchaser to free and clear ownership of the property. A potential purchaser is encouraged to contact the county register of deeds office or a title insurance company, either of which may charge a fee for this information. The Mortgage in default and being foreclosed is described as: The Future Advance Mortgage made by Simplified Facilities, LLC, as mortgagor (“Mortgagor”), to First National Bank of Michigan, a national banking association, as mortgagee (“Lender”), dated February 16, 2023 and recorded March 7, 2023 as Instrument No. 202303070011709 Kent County Records, Michigan (the “Mortgage”). The amount due on the Mortgage as of the date of this Notice is $5,085,954.54 plus certain costs and expenses paid by Lender to collect the debt and to protect its interest in the property, all of which is due under the terms of the Mortgage. The Mortgage contains a power of sale and no suit or proceeding at law or in equity has been instituted to recover the debt secured by the Mortgage, or any part of the Mortgage. The public auction described above may be adjourned to a later date; and the specific location within the place of holding of the circuit court where the public auction is held may be designated by the sheriff or deputy sheriff conducting the sale. Lender will apply the sale proceeds to the amount due on the Mortgage as stated above, plus any amount subsequently paid by Lender to protect its interest in the property and interest on the amount due at the rate of 8.27 percent per annum. The mortgaged premises (collectively, the “Mortgaged Property”) to be sold at foreclosure sale is located in the City of Grand Rapids, Kent County, Michigan, and is described more particularly as: Unit 1, Ottawa and Fountain Condominium, a condominium according to the Master Deed recorded in Instrument No. 20050627-0074304, as amended, and designated as Kent County Condominium Subdivision Plan No. 751, together with rights in the general common elements and limited common elements as set forth in the above Master Deed and as described in Act 59 of the Public Acts of 1978, as amended. Commonly known as: 116 Ottawa Avenue NW, Grand Rapids, MI 49503 Tax Parcel No.: 41-13-25-282-020 Together with all tangible personal property and fixtures described in the Mortgage, including, but not limited to, the following: All privileges, appurtenances, improvements, buildings, tenements, hereditaments, easements, rights of way, licenses, permits, riparian and littoral rights, mineral/oil/gas/water rights, rights to adjoining land, and all other rights belonging to the Premises and which may hereafter attach thereto. All rights to make divisions of the Premises that are exempt from the platting requirements of the Michigan Land Division Act, as it shall be amended (collectively, the “Easements”); and All equipment, other goods, and fixtures of every kind and nature whatsoever, now or hereafter located in or upon the Premises or any part thereof and used or useable in connection with any present or future operation of such premises (hereinafter called “Equipment and Fixtures”), whether now owned or hereafter acquired by the Mortgagor, including, without limitation, all heating, air conditioning, ventilation, lighting, incinerating and power equipment, engines, signs, security systems, fences, hoists, cranes, compressors, pipes, pumps, tanks, motors, plumbing, cleaning, fire prevention, fire extinguishing, apparatus, elevators, escalators, shades, awnings, screens, storm doors and windows, appliances, attached cabinets, partitions, carpeting, ground maintenance equipment, and similar types of equipment, all of which shall be deemed to be real estate (collectively, the “Personal Property”); and all “as-extracted collateral” related to the Premises. The tangible personal property and fixtures constituting a part of the Mortgaged Property shall be sold together with the real estate in one foreclosure sale, in accordance with MCL 440.9604(1)(b) and MCL 440.9604(2)(b), respectively. There is no warranty in disposition relating to title, possession, quiet enjoyment, or any other matter as to any or all of the personal property and fixtures described above. The redemption period shall be six months from the date of sale pursuant to MCL 600.3240(7). Pursuant to MCL 600.3212(g), take notice that the mortgagor will be held responsible to the person who buys the Mortgaged Property at the mortgage foreclosure sale or to the mortgage holder for damaging the Mortgaged Property during the redemption period, as further provided in MCL 600.3278.
