NOTICE OF MORTGAGE FORECLOSURE SALE Notice of foreclosure by advertisement. Notice is given under section 3212 of the revised judicature act of 1961, 1961 PA 236, MCL 600.3212, that the following mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at a public auction sale to the highest bidder for cash or cashier's check at the place of holding the circuit court in Calhoun County, starting promptly at 9 a.m., on Thursday, June 11, 2026. The amount due on the mortgage may be greater on the day of the sale. Placing the highest bid at the sale does not automatically entitle the purchaser to free and clear ownership of the property. A potential purchaser is encouraged to contact the county register of deeds office or a title insurance company, either of which may charge a fee for this information. The Mortgage described below is in default: Residential Mortgage ("Mortgage") made by John L. Clark, as mortgagor, to Battle Creek Area Habitat for Humanity, a Michigan not-for-profit corporation, as mortgagee ("Lender"), dated August 25, 2009 and recorded September 3, 2009 in Liber 3486, Page 583, Calhoun County Records. The amount due on the Mortgage as of the date of this Notice is $10,064.25 plus certain costs and expenses paid by Lender to collect the debt and to protect its interest in the property, all of which is due under the terms of the Mortgage. The Mortgage contains a power of sale and no suit or proceeding at law or in equity has been instituted to recover the debt secured by the Mortgage, or any part of the Mortgage. Take notice that on Thursday, June 11, at 9 a.m., local time, or any adjourned date thereafter, the Mortgage will be foreclosed by sale at public auction to the highest bidder at Room F225 of the Calhoun County Justice Complex, or such other place of holding the circuit court within the county where the property to be sold at foreclosure is located as may be designated by the sheriff or deputy sheriff conducting the sale. Lender will apply the sale proceeds to the amount due on the Mortgage as stated above plus interest on the amount due at the rate of eleven (11) percent per annum, and any amount subsequently paid by Lender to protect its interest in the property. If the property is sold at a foreclosure sale, the borrower will be held responsible to the property's buyer at the mortgage foreclosure sale or to the mortgage holder for damaging the property during the redemption period. Attention homeowner: if you are a military service member on active duty, if your period of active duty has concluded less than 90 days ago, or if you have been ordered to active duty, please contact the attorney for the party foreclosing the mortgage at the telephone number stated on this notice.
