NOTICE OF ASSOCIATION LIEN FORECLOSURE SALE WHEREAS, default has been made in the terms and conditions of the Supplementary Declaration of Building and Use Restrictions of Enchanted Forest dated September 2, 1971, signed on August 4, 1971, and recorded on September 12, 1971, in Liber 160, Page 164 et seq., Otsego County, Michigan, Register of Deeds, and any amendments thereto (the “Declaration”). Said default under the Declaration has resulted in the recordation of a “Affidavit of Lien” by Enchanted Forest Property Owners Association, said Affidavit of Lien being dated June 30, 2025, signed on June 30, 2025, and recorded on June 30, 2025, in Liber 1685, Page 315, Otsego County, Michigan, Register of Deeds (the “Lien”) on which Lien there is claimed to be due, as of the date hereon, the sum of THREE THOUSAND TWO HUNDRED EIGHTY-SEVEN AND 89/100 DOLLARS ($3,287.89). Under the power of sale contained in Article VI of the Declaration, please take notice as follows: Notice of foreclosure by advertisement. Notice is given under section 3212 of the revised judicature act of 1961, 1961 PA 236, MCL 600.3212, that the following Lien will be foreclosed by a sale of the liened premises, or some part of them, at a public auction sale to the highest bidder for cash or cashier’s check at the place of holding the circuit court in Otsego County, starting promptly at 10:00 AM, on April 16, 2026. The amount due on the Lien may be greater on the day of the sale. Placing the highest bid at the sale does not automatically entitle the purchaser to free and clear ownership of the premises. A potential purchaser is encouraged to contact the county register of deeds office or a title insurance company, either of which may charge a fee for this information. Said premises are located in the Township of Frederic, County of Otsego, State of Michigan, and more particularly described as: Lot 546, Enchanted Forest No. 3, Township of Otsego Lake, Otsego County, Michigan, according to the recorded Plat thereof, as recorded in Liber 3 of Plats, Pages 195-199, Otsego County Records. The redemption period shall be six (6) months from the date of such sale pursuant to MCL 600.3240(8) unless the property is determined abandoned in accordance with MCL 600.3241a, then, in that event, the redemption period shall be thirty (30) days from the date of such sale or until the time to provide the notice required by MCL 600.3241a(c) expires, whichever is later, pursuant to MCL 600.3240(8), after which Mark Canter and all persons claiming through or under him shall be forever barred from all equity of redemption.
