NOTICE OF FORECLOSURE BY ADVERTISEMENT Notice is given under Section 108 of the Condominium Act, Act 59 of the Public Acts of 1978, MCL 559.208, and Section 3212 of the Revised Judicature Act of 1961, 1961 PA 236, MCL 600.3212, that the following Lien will be foreclosed by a sale of the subject premises, or some part of them, at a public auction sale to the highest bidder for cash or cashier's check at the place of holding the Circuit Court in Calhoun County, starting promptly at 9:00 AM, on June 4, 2026. The amount due may be greater on the day of the sale. Placing the highest bid at the sale does not automatically entitle the purchaser to free and clear ownership of the property. A potential purchaser is encouraged to contact the county register of deeds office or a title insurance company, either of which may charge a fee for this information. The Living Trust of John R. Young, dated December 7, 1973 (the "Owner") is the record owner of property located in Bay Tower Condominium (the "Condominium"), a condominium development established by the Master Deed recorded Liber 1194, Page 135, Calhoun County Records (the "Master Deed"), and designated as Calhoun County Condominium Subdivision Plan No. 5. The Master Deed and Section 108 of the Condominium Act, Act 59 of the Public Acts of 1978, as amended, provide Bay Tower Condominium Association (the "Association") with the right to levy assessments against the property located in the Condominium. On March 11, 2026, the Association prepared a Claim of Condominium Assessment Lien (the "Lien") against the Owner's property legally described therein. The Lien was recorded on March 17, 2026, at Liber 4986, Page 486, Calhoun County Records, along with an Affidavit of Scrivener's Error related to such Lien, which was recorded on March 30, 2026, at Liber 4989, Page 153, Calhoun County Records. As of the date of this Notice, there is claimed to be due and unpaid the sum of One Hundred Twenty Three Thousand Two Hundred Forty One and 12/100 Dollars ($123,241.12) in assessments, fines, late charges, accrued interest, and costs. Future assessments, fines, late charges, interest, and costs will continue to accrue. No suit or proceeding has been instituted to recover any part of the debt secured by the Lien. On Thursday, June 4, 2026, at 9:00 AM, at the Calhoun County Courthouse, 161 Michigan Avenue, Battle Creek, MI 49014, which is the place for holding foreclosure sales for Calhoun County, Michigan, there will be offered for sale and sold to the highest bidder at public sale, for the purpose of satisfying the amounts due and unpaid on the Lien, together with the legal costs and charges of sale, including attorneys' fees allowed by law, the real property located in the City of Battle Creek, County of Calhoun, State of Michigan, described as follows: Unit No. 9, Bay Tower Condominium, according to the Master Deed recorded in Liber 1194, Page 135, as amended, and designated as Calhoun County Condominium Subdivision Plan No. 5, together with rights in the general common elements and the limited common elements as shown on the Master Deed and as described in Act 59 of the Public Acts of 1978, as amended. Commonly known as: 251 Columbia Ave., Unit 9, Battle Creek, MI 49015 Parcel Number: 0870-09-133-0 If the property is eventually sold at foreclosure sale, the redemption period will be six (6) months from the date of sale unless the property is abandoned, in which case the redemption period can be shortened in accordance with Michigan law. If the property is sold at a foreclosure sale, the Owner will be responsible to the person who buys the property at the foreclosure sale or to the Association for damaging the property during the redemption period.
