NOTICE OF FORECLOSURE BY ADVERTISEMENT Notice of foreclosure by advertisement. Notice is given under section 3212 of the revised judicature act of 1961, 1961 PA 236, MCL 600.3212, that the following mortgage be foreclosed by a sale of the mortgaged premises, or some part of them, at public auction sale to the highest bidder for cash or cashier's check at that place where Circuit Court is held in Oakland County, Michigan, starting promptly at 10:00 a.m., on Tuesday, April 28, 2026. The amount due on the mortgage may be greater on the day of the sale. Placing the highest bid at sale does not automatically entitle the purchaser to free and clear ownership of the property. A potential purchaser is encouraged to contact the county register of deeds office or a title insurance company, either of which may charge a fee for this information. Default has been made in the conditions of a certain Mortgage (“Mortgageâ€) to secure an indebtedness in the original amount of $425,000.00, from TKB Company LLC, the Mortgagor, to Velocity Commercial Capital, LLC, Mortgagee, February 28, 2025, and filed of record on April 4, 2025, as Instrument No. 035861, Liber 6009, Page 859, in the Register of Deeds Office of Oakland County, Michigan, on which Mortgage there is claimed to be due the amount of $479,225.70 as of January 31, 2026, plus regular and default interest accruing on the principal at the rate of 17.24% per annum, plus loan fees that continue to accrue thereafter, plus late charges, corporate advances, and escrow advances that continue to accrue thereafter, plus any applicable contractual prepayment penalty, plus legal fees and costs. No suit or proceeding at law has been instituted to recover the debt secured by said Mortgage or any part thereof. Said premises are commonly known as 3961 & 3995 12 Mile Road, Berkley, MI 48072, situated in Oakland County, Michigan, and are described as follows: Land situated in the City of Berkley, County of Oakland, State of Michigan to wit: Lots 27, 28, 29, 30, 31 and IOI, Berkley School-Park, according to the plat thereof as recorded in Liber30 of Plats, Page 10, Oakland County Records Notice is further given that the length of the redemption shall be six months from the date of sale.
