NOTICE OF FORECLOSURE BY ADVERTISEMENT PLEASE TAKE NOTICE that a default has been made in the conditions of a certain Mortgage granted by Jesse Bandy, a married man, sole ownership, as Mortgagor, to Arbor Financial Credit Union, as Mortgagee, dated September 20, 2024, recorded September 23, 2024, in Liber 3434 page 4192, Berrien County Records, for Berrien County, Michigan (the "Mortgage") and the Mortgage is being foreclosed upon by Mortgagee. The premises subject to this foreclosure are located in the Township of Niles, County of Berrien, State of Michigan, and described as: Lot 125 in Oak Manor No. 1, according to the Plat thereof recorded in Volume 12 of plats, Page 28, Berrien County Records. which is commonly known as: 3 Alice Ct., Niles, MI 49120 Tax Parcel No. 11-14-5580-0125-00-2 No suit or proceeding at law or in equity has been instituted against the Mortgagor to recover the debt, or any part of the debt, secured by the Mortgage, and the power of sale in the Mortgage has become operative by reason of default. There is claimed to be an indebtedness, as defined by the Mortgage, due and unpaid in the amount One Hundred Thousand Five Hundred Seventy-Three Dollars and Fifty-nine cents ($100,573.59) including principal and interest, and other costs secured by the Mortgage. The indebtedness continues to increase at the per diem rate of $16.65. NOTICE IS HEREBY GIVEN under section 3212 of the revised judicature act of 1961, 1961 PA 236, MCL 600.3212, that on Thursday, July 30, 2026 at 11:00 a.m. in the 2nd floor jury room of the Courthouse in St. Joseph, Michigan located at 811 Port St., St. Joseph, MI 49085, that being the place of holding of the Circuit Court for the County of St. Joseph County, Michigan, the premises will be offered for sale and sold to the highest bidder, at public sale, for the purposes of satisfying the amount of the indebtedness then due on the Mortgage, together with interest, costs, attorney fees, taxes, insurance, and any other advances and expenses due under the Mortgage or permitted under Michigan law. The amount due on the mortgage may potentially be greater on the date of the sale than the indebtedness listed in this Notice. Placing the highest bid does not automatically entitle the purchaser to free and clear ownership of the property. A potential purchaser is encouraged to contact the county register of deeds office or a title insurance company, either of which may charge a fee for this information. The period within which the premises may be redeemed shall expire six (6) months from the date of sale, unless determined to be abandoned in accordance with MCL 600.3241a, in which case the redemption period shall be thirty (30) days from the date of sale. Pursuant to MCL 600.3278, the Mortgagors and any other person liable on the Mortgage will be held responsible to the Mortgagee or the person who buys the property at the mortgage foreclosure sale or to the mortgage holder for damages sustained by the property during the redemption period.
