MORTGAGE FORECLOSURE NOTICE DEFAULT having been made in the terms and conditions of a certain mortgage made by Michael Stilson, a married man (“Borrower”) whose mailing address is 5407 Tall Timber Trail, Gaylord, MI 49735, to Orsa Credit Union f/k/a Community Financial Credit Union, 500 S. Harvey, Plymouth, MI 48170, dated August 17, 2023 and recorded on August 22, 2023, in Liber 1637, Page 150, Otsego County Records, which mortgage there is claimed to be due at the date of this notice the sum of ONE HUNDRED THIRTY-THREE THOUSAND EIGHT HUNDRED THIRTY-TWO AND 48/100 DOLLARS ($133,832.48) plus interest, at a rate of 7.625% per annum, together with any additional sum or sums which may be paid by the undersigned as provided for in said mortgage, and no suit or proceedings at law or in equity having been instituted to recover the debt secured by said mortgage, or any part thereof. NOW, THEREFORE, by virtue of the power of sale contained in said mortgage, and pursuant to the statute of the State of Michigan in such case made and provided, notice is hereby given that the undersigned will sell at public auction to the highest bidder, the premises described in said mortgage or so much thereof as may be necessary to pay the amount due on said mortgage, including all legal costs, charges and expenses, including the attorney fees allowed by law, and also any sum or sums which may be paid by the undersigned, necessary to protect its interest in the premises. Which said premises are described as follows: Property situated in the Township of Hayes, County of Otsego, State of Michigan, more particularly described as follows: PARCEL NO. 63, NORTHWOOD ESTATES NO. 3, according to the survey thereof as recorded in Liber 153, Pages 172-179, and Liber 175, Page 181, Otsego County Records, and more particularly described as: Commencing at the West ¼ corner of Section 22, Town 30 North, Range 4 West, thence South 88 deg. 40’ East along the East-West ¼ line 2907.95 feet for a place of beginning; thence continuing South 88 deg. 40’ East 329.0 feet, thence North 00 deg. 32’15” West 1326.07 feet; thence North 88 deg. 43’ West 329.0 feet; thence South 00 deg. 32’15” East 1325.83 feet to the place of beginning, being a part of the North ½ of Section 22, Town 30 North, Range 4 West. The Northerly 33.0 feet of the above described parcel is subject to an easement to be used in common with others, for ingress and egress, and the installation and maintenance of public utilities. TOGETHER WITH an easement 66.0 feet wide lying 33.0 feet either side of a centerline described as: Commencing at the North ¼ corner of Section 22, Town 30 North, Range 4 West, thence South 88 deg. 47’ East along section line 713.2 feet for a place of beginning; thence South 00 deg. 06’40” East 1325.88 feet; thence North 88 deg. 43’ West 3295.0 feet; thence South 88 deg. 39’ West 686.20 feet; thence North 00 deg. 15’ West 1313.67 feet for a place of ending. Said place of ending lies on section line. Said easement to be used in common with others, for ingress and egress, and the installation and maintenance of public utilities. Commonly Known As: 5407 Tall Timber Trail, Gaylord, MI 49735 Tax Identification No: 071-022-100-055-00 The redemption period shall be six (6) months from the date of such sale unless the property is determined abandoned in accordance with 1948 CL 600.3241a, in which case the redemption period shall be thirty (30) days from the date of such sale. If the property is sold at foreclosure sale under Chapter 32 of the Revised Judicature Act of 1961, pursuant to MCL 600.3278 the borrower will be held responsible to the person who buys the property at the mortgage foreclosure sale or to the mortgage holder for damaging the property during the redemption period.
