Public Foreclosure Notice
NOTICE OF MORTGAGE FORECLOSURE SALE This firm is a debt collector attempting to collect a debt. Any information we obtain will be used for that purpose. Notice of foreclosure by advertisement. Notice is given under section 3212 of the revised judicature act of 1961, 1961 PA 236, MCL 600.3212, that the following mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at a public auction sale to the highest bidder for cash or cashier's check at the place of holding the circuit court in Jackson County, Michigan, starting promptly at ten o'clock in the forenoon on Wednesday, August 12, 2026. The amount due on the mortgage may be greater on the day of the sale. Placing the highest bid at the sale does not automatically entitle the purchaser to free and clear ownership of the property. A potential purchaser is encouraged to contact the county register of deeds office or a title insurance company, either of which may charge a fee for this information. The mortgage was made by JAMES A. DEKARSKE and DEBRA K. DEKARSKE, husband and wife (collectively, "Mortgagor"), to BANK MICHIGAN F/K/A OSB COMMUNITY BANK, a Michigan banking corporation, having an office at 417 S. Main Street, Brooklyn, Michigan 49230 (the "Mortgagee"), dated July 2, 2009, and recorded in the office of the Register of Deeds for Jackson County, Michigan on August 10, 2009, in Liber 1926, Page 1015 (the "Mortgage"). By reason of a default under the conditions of the Mortgage, the Mortgagee elects to declare and hereby declares the entire unpaid amount of the Mortgage due and payable forthwith. Mortgagee is the owner of the indebtedness secured by the Mortgage. The premises covered by the Mortgage are situated in the Township of Rives, County of Jackson, State of Michigan, and are described as follows: Being a part of the East 1/2 of the Southwest 1/4, lying South of Maple Grove Road, Section 35, Town 1 South, Range 1 West, Rives Township, Jackson County, Michigan, more particularly described as: Beginning at a point distant on the East line of the Southwest 1/4, North 01 degrees 13 minutes 34 seconds West along said East line, 1957.42 feet from the South 1/4 post of said section; thence South 88 degrees 45 minutes 08 seconds West parallel with the North line of the Southwest 1/4, 822.37 feet to a 3/4 inch pipe; North 03 degrees 28 minutes 00 seconds East perpendicular to the center of Maple Grove Road, 452.16 feet to the center of said road; South 86 degrees 32 minutes 00 seconds East along the center of Maple Grove Road and perpendicular to aforementioned line, 44.89 feet to a point of curve; Northeasterly along the center of Maple Grove Road on the arc of a curve to the left, (Radius: 488.5935 feet, Central Angle: 28 degrees 02 minutes 23.0 seconds, Chord Bearing: North 79 degrees 26 minutes 49 seconds East, Chord Length: 236.7317 feet) 239.11 feet to the point of tangent; North 65 degrees 25 minutes 37 seconds East along the center of Maple Grove Road, 446.12 feet to a point of curve; Northeasterly along the center of Maple Grove Road on the arc of a curve to the right, (Radius: 453.2774 feet, Central Angle: 12 degrees 54 minutes 03.8 seconds, Chord Bearing: North 71 degrees 52 minutes 39 seconds East, Chord Length: 101.8471 feet) 102.06 feet to a concrete monument on the East line of the Southwest 1/4 (said point being the center 1/4 post of Section 35); South 01 degrees 13 minutes 34 seconds East, along the East line of the Southwest 1/4, 691.43 feet to a 3/4 inch pipe at the point of beginning Together with all the improvements erected on the real estate, and all easements, appurtenances, and fixtures a part of the property, and all replacements and additions. If the premises are abandoned, the redemption period will be the later of thirty (30) days from the date of the sale or upon expiration of fifteen (15) days after the Mortgagor is given notice pursuant to MCLA §600.3241a(b) that the premises are considered abandoned and Mortgagor, Mortgagor's heirs, executor, or administrator, or a person lawfully claiming from or under one (1) of them has not given the written notice required by MCLA §600.3241a(c) stating that the premises are not abandoned. If the premises are sold at a foreclosure sale, under MCLA §600.3278 the Mortgagor will be held responsible to the person who buys the premises at the mortgage foreclosure sale or to the Mortgagee for damaging the premises during the redemption period.
