FORECLOSURE NOTICE ATTENTION TO HOMEOWNER: If you are a military service member on active duty, if your period of active duty has concluded less than 90 days ago, or if you have been ordered to active duty, please contact the attorney for the party foreclosing the Notice of Lien at the telephone number stated in this notice. Default has been made by Crystal Duvall, of 1012 Fairfield Dr., Unit 86, Bldg. 21, Hudsonville, Michigan 49426 (the “Owner”), in the terms and conditions of the recorded Consolidating Master Deed dated January 12, 1995, recorded January 19, 1995, in Liber 1933, Page 526, Ottawa County, Michigan records, as amended, by reason of Owner's failure to pay monthly dues and other sums owed to VILLAGE OF FAIRFIELD CONDOMINIUM ASSOCIATION, a Michigan nonprofit corporation (the “Association”). A Claim of Lien for nonpayment of Association assessments was recorded with the Ottawa County Register of Deeds on September 30, 2025, as Instrument No. 2025-0027086, and was amended and restated in its entirety by that certain Amended and Restated Claim of Lien dated April 14, 2026, which was recorded by the Ottawa County Register of Deeds on April 16, 2026, as Instrument No. 2026-0010838 (collectively, the "Notice of Lien") and has been served upon the Owner. The amount owed under the Notice of Lien as of the date of this Notice is Eleven Thousand One Hundred Fifty-Three and 87/100 Dollars ($11,153.87). Notice of foreclosure by advertisement – notice is given under Section 3212 of the Revised Judicature Act of 1961, 1961 PA 236, MCL 600.3212 and under the power of sale contained in the Consolidating Master Deed dated January 12, 1995, recorded in Liber 1933, Page 526, recorded in Ottawa County, Michigan records, that the above Notice of Lien will be foreclosed by a sale of the liened premises, or some part of them, at public auction sale to the highest bidder for cash or cashier's check at the place of holding the circuit court in Ottawa County (that being the 414 Washington Ave., Grand Haven, Michigan 49417), starting promptly at 10:00 a.m. on Thursday, the 13th day of August, 2026. The amount due on the Notice of Lien may be greater on the day of the sale and may include interest, costs, charges and expenses, including attorney fees, and also any sums which may be paid by the Association in order to protect its interests. Placing the highest bid at the sale does not automatically entitle the purchaser to free and clear ownership of the premises. A potential purchaser is encouraged to contact the County Register of Deeds office or a title insurance company, either of which may charge a fee for this information. Said premises are situated in the Township of Georgetown, Ottawa County, Michigan, and are described as: Unit No. 86 in Fairway Estates-Village of Fairfield, a condominium according to the Consolidating Master Deed recorded in Liber 1933, Page 526, and any amendments thereto, inclusive, in the office for the Ottawa County Register of Deeds, and designated as Ottawa County Condominium Subdivision Plan No. 107, together with rights in general common elements and in limited common elements as set forth in said Master Deed and as described in Act 59 of the Public Acts of 1978, as amended. If the premises is sold at foreclosure sale under Chapter 32 of the Revised Judicature Act of 1961, as amended, then under applicable law, including MCL 600.3278, the owner of the premises will be held responsible to the person who buys the premises at the foreclosure sale and/or to the Association for damaging the premises during the redemption period.
